1. Scope and Application

This Privacy Policy describes the manner in which Hero Group LLC, on behalf of itself and its affiliated brands, subsidiaries, and related entities, including Reclaimr LLC and Truck Hero LLC, collects, uses, discloses, and otherwise processes personal information through the websites located at herogroup.ai, reclaimr.ai, and truckhero.ai, together with any related landing pages, microsites, event or conference lead capture pages, downloadable resource pages, waitlists, forms, and other online properties that link to this Privacy Policy (collectively, the “Sites”). For purposes of this Privacy Policy, Hero Group LLC and the affiliated entities covered by this Privacy Policy are referred to collectively as the “Company.”

This Privacy Policy applies only to personal information collected through the Sites and related website interactions. This Privacy Policy does not apply to any software product, platform, customer environment, or service unless that offering separately links to or expressly incorporates this Privacy Policy.

2. Personal Information Collected

The Company may collect personal information provided directly through the Sites, including name, email address, phone number, company name, job title, shop or business name, city, state, or province, form responses, message content, meeting request or scheduling information, newsletter or marketing preferences, event or conference registration details, estimating platform information, repair volume information, and any other information voluntarily submitted through the Sites.

The Company may also collect certain information automatically when an individual visits or interacts with the Sites, including IP address, browser type and version, device type, operating system, referral source, pages viewed, links clicked, time spent on pages, date and time of access, approximate location derived from IP address, cookie identifiers, and other usage and interaction data relating to the Sites.

In addition, the Company may receive personal information from third parties, including analytics providers, advertising and marketing platforms, customer relationship management tools, scheduling providers, email and form service providers, social media platforms, event or conference lead collection tools, affiliated entities, and publicly available sources.

3. Sources of Personal Information

Personal information may be collected directly from individuals, automatically through interaction with the Sites, through cookies and similar tracking technologies, from service providers and vendors, from advertising, analytics, and marketing partners, from affiliated entities, and from publicly available sources. The Company may combine personal information collected through the Sites with information obtained from other lawful sources to the extent permitted by applicable law.

4. Future Website Features

The Sites may, now or in the future, include features such as chatbots, conversational assistants, file or document uploads, customer portals, or text-message based communications. If such features are made available and used, the Company may collect and process information submitted through those features in accordance with this Privacy Policy and applicable law.

5. Purposes of Processing

The Company may collect, use, disclose, and otherwise process personal information for legitimate business and operational purposes, including to operate, maintain, and improve the Sites; respond to inquiries and communicate with individuals; schedule demos, meetings, and follow-up discussions; provide requested materials, resources, or information; administer waitlists, newsletters, campaigns, and event registrations; send marketing, promotional, and business development communications; personalize outreach and better understand potential interest in the Company’s offerings; support analytics, attribution, audience measurement, and advertising effectiveness; improve sales, marketing, and support workflows; protect the security and integrity of the Sites and the Company’s business; detect, investigate, prevent, or address fraud, abuse, security incidents, or unlawful conduct; enforce legal terms, policies, and rights; comply with legal, regulatory, tax, accounting, and reporting obligations; carry out internal administrative and operational functions; and carry out any other purpose disclosed at the time of collection or otherwise permitted by law.

6. Cross-Brand Use of Information

Because the Sites are operated by Hero Group LLC on behalf of itself and affiliated brands and subsidiaries, personal information submitted through one Site may be accessed, used, and shared internally by the Company for the purposes described in this Privacy Policy. Accordingly, an individual who submits information through one of the Sites may be contacted by Hero Group LLC or another affiliated Company entity regarding related offerings, services, updates, or opportunities that may be relevant to that individual’s interests, subject to applicable law.

7. Cookies and Similar Technologies

The Company and its service providers may use cookies, pixels, tags, scripts, SDKs, local storage, and similar technologies on the Sites. Such technologies may be used for essential website functions, including security, network management, and page navigation; for analytics purposes, including understanding how users interact with the Sites and improving performance and usability; for advertising purposes, including retargeting, attribution, and campaign measurement; and for functionality purposes, including remembering preferences and improving the user experience.

Where required by applicable law, including in Canada with respect to non-essential cookies, the Company will obtain consent before using non-essential cookies or similar technologies. Cookie preferences may also be managed through the Company’s cookie banner or consent manager where available, and through browser settings, although disabling certain cookies may affect Site functionality.

8. Analytics, Advertising, and Tracking Tools

The Company currently uses certain third-party analytics, advertising, and tracking tools on the Sites, including Google Analytics, Google Ads, and LinkedIn Insight Tag. These tools may be used for analytics, advertising, attribution, retargeting, campaign measurement, lead intelligence, and related business purposes.

The Company may also use additional service providers and tools now or in the future for hosting, infrastructure, customer relationship management, scheduling, forms, cloud storage, communications, analytics, advertising, and related operations, including tools similar to HubSpot, Apollo, Clearbit, Segment, Hotjar, Microsoft Clarity, and comparable vendors. Such third parties may collect information from or about interactions with the Sites through cookies and similar technologies, and their processing of information is governed by their own privacy practices and applicable agreements.

9. Disclosure of Personal Information

The Company may disclose personal information to affiliated entities, subsidiaries, and related brands; to vendors, service providers, processors, and contractors that support the Sites or the Company’s business; to hosting, infrastructure, analytics, advertising, customer relationship management, scheduling, communications, form processing, storage, and email providers; to professional advisors such as lawyers, accountants, auditors, consultants, and insurers; to government authorities, regulators, law enforcement, or other parties where required by law or legal process; to parties where necessary to protect the rights, users, Sites, property, or business of the Company; to parties involved in an actual or proposed merger, acquisition, financing, restructuring, asset sale, bankruptcy, or similar corporate transaction; and to any other person or entity with the relevant individual’s consent or at that individual’s direction.

Website lead information is not currently disclosed to channel partners or resellers for their own independent marketing use.

10. Sale, Sharing, and Targeted Advertising

The Company does not sell personal information for monetary consideration. However, certain uses of cookies, pixels, analytics, and advertising technologies may constitute “sharing,” “sale,” or processing for “targeted advertising” under certain U.S. state privacy laws, depending on how those laws define those terms. Where applicable law grants a right to opt out of such activities, the Company will provide a method to exercise that right.

11. Privacy Choices

An individual may opt out of promotional emails by using the unsubscribe link included in those emails or by contacting the Company at info@herogroup.ai. Even if promotional communications are discontinued, the Company may still send non-promotional communications, including relationship, legal, administrative, or transactional communications where permitted by law.

By providing your phone number and opting in to receive text messages, you agree to receive recurring automated marketing and transactional text messages (e.g., SMS and MMS) from the Company, including those sent via an automatic telephone dialing system.

  • Opt-Out: You can cancel the SMS service at any time by texting “STOP” to the number from which you received the message. After you send “STOP,” we will send you a final SMS to confirm that you have been unsubscribed.
  • Help: For additional support or assistance, text “HELP” to the number from which you received the message or email info@herogroup.ai.
  • Costs: Message and data rates may apply for any messages sent to you or from you. Message frequency varies based on your interactions with the Sites.
  • Privacy: Consent to receive automated marketing text messages is not a condition of any purchase. Your SMS opt-in data will not be shared with third parties for their independent marketing use.

Cookie preferences may be managed through the Company’s cookie banner or consent manager where available, and through browser settings. Where required by law, the Sites may also provide a footer link such as “Your Privacy Choices” or “Do Not Sell or Share My Personal Information” to enable individuals to exercise applicable rights relating to targeted advertising, sale, or sharing of personal information.

If an individual is located in Canada, consent to receive marketing communications may be withdrawn at any time, subject to legal or contractual restrictions and reasonable notice.

12. Do Not Track and Opt-Out Preference Signals

Some browsers and browser extensions offer “Do Not Track” settings or opt-out preference signals. Because “Do Not Track” is not a uniform standard, the Sites may not respond to every browser-based do-not-track signal. However, where required by applicable law, the Company will honor recognized opt-out preference signals relating to targeted advertising, sale, or sharing of personal information.

13. Sensitive Information

The Sites are not intended to collect sensitive personal information unless specifically requested and legally permitted. Sensitive personal information should not be submitted through the Sites unless expressly requested by the Company. If information that may be considered sensitive under applicable law is voluntarily provided, such submission will be treated as a decision by the submitting individual to provide that information, and the Company may process it as permitted by law, including to provide requested communications, maintain records, protect rights, or comply with legal obligations.

14. Retention of Personal Information

Personal information collected through the Sites is generally retained for as long as possible to fulfill the purposes outlined – or until a request for deletion is made. We will remove personal information from our systems within 7 days of receipt of a request. . 

Information may be retained for a longer period where reasonably necessary to comply with legal, tax, accounting, or reporting obligations, resolve disputes, enforce agreements, detect or prevent fraud, abuse, or security incidents, establish, exercise, or defend legal claims, or maintain appropriate business records. Information may also be deleted, anonymized, or aggregated sooner where appropriate.

15. Data Security

The Company uses commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information collected through the Sites. However, no method of transmission over the internet and no method of electronic storage is completely secure, and absolute security cannot be guaranteed.

16. Children’s Privacy

The Sites are not directed to children under the age of thirteen, and the Company does not knowingly collect personal information from children under the age of thirteen through the Sites. If it is believed that a child under the age of thirteen has submitted personal information through the Sites, the Company should be contacted at info@herogroup.ai so that the matter may be reviewed and appropriate action taken.

17. Third-Party Links and Services

The Sites may contain links to third-party websites, tools, applications, or services. The Company is not responsible for the privacy, security, or content practices of third parties. Interactions with third parties are governed by the applicable third party’s own terms and privacy policies.

18. U.S. State Privacy Rights

Depending on an individual’s state of residence and subject to applicable law, certain rights may apply with respect to personal information. Such rights may include the right to confirm whether personal information is processed, access personal information, correct inaccurate personal information, delete personal information, obtain a portable copy of certain personal information, opt out of targeted advertising, opt out of the sale or sharing of personal information where applicable, opt out of certain profiling in furtherance of decisions that produce legal or similarly significant effects where applicable, limit certain uses of sensitive personal information where applicable, appeal the denial of a request where applicable, and not be discriminated against for exercising privacy rights.

A privacy request may be submitted by emailing info@herogroup.ai with the subject line “Privacy Request” and providing sufficient information to allow the Company to understand, evaluate, and respond to the request. The Company may take reasonable steps to verify identity before processing certain requests, including requesting confirmation of information already associated with the individual, such as email address and the nature of prior interactions.

Where required by law, including for certain California residents, an authorized agent may submit a request on behalf of an individual. In such cases, the Company may require proof of the agent’s authority and may also require the relevant individual to verify identity directly.

If a request is denied and applicable law provides an appeal right, an appeal may be submitted by emailing info@herogroup.ai with the subject line “Privacy Appeal” and identifying the original request and the basis for the appeal.

If California law applies, California residents may have rights under the California Consumer Privacy Act, as amended, including rights to know, access, correct, delete, and opt out of certain sale or sharing activities. The Company does not sell personal information for money.

19. Canadian Privacy Rights

If an individual is located in Canada, Hero Group LLC is the organization accountable for personal information collected through the Sites on behalf of itself and the affiliated brands and entities covered by this Privacy Policy. By submitting personal information through the Sites, the submitting individual consents to the collection, use, and disclosure of that information as described in this Privacy Policy, subject to applicable law.

Subject to legal limitations and exceptions, an individual in Canada may request access to personal information held by the Company and request correction of inaccurate information. Consent to receive marketing communications may also be withdrawn at any time, subject to legal or contractual restrictions and reasonable notice. A privacy request from Canada may be submitted by emailing info@herogroup.ai with the subject line “Canada Privacy Request.”

20. International Transfers

The Sites are intended primarily for visitors in the United States and Canada. Personal information may be collected, stored, processed, or accessed in the United States or other jurisdictions where the Company or its service providers operate. Those jurisdictions may have privacy laws that differ from those of an individual’s province, territory, state, or place of residence. By using the Sites or submitting information through them, it is understood that personal information may be transferred to and processed in jurisdictions outside the individual’s own jurisdiction, subject to applicable law.

21. Changes to This Privacy Policy

This Privacy Policy may be updated from time to time. When updates are made, the revised version will be posted on the applicable Site and the Effective Date will be revised accordingly. Continued use of the Sites after any revised Privacy Policy becomes effective constitutes acknowledgment of the updated Privacy Policy to the extent permitted by law.
